Useful summary of US age discrimination legislation

by on September 27, 2013

The US age discrimination legislation is very different from the UK and provision within EU frameworks, most notably as it recognises age discrimination as an issue impacting those aged 40 and over only.  To progress a claim employees must show that they were at least 40 years old, qualified, suffered an adverse employment action, and that there is additional evidence that shows age was a factor in the adverse action.  This very useful summary provides a link to detailed description of the US legislation by Fisher and Phillips LLP.
