Bovis Homes – no finding of age discrimination

A former commercial director of Bovis Homes has lost his claim for age discrimination against the company.

According to this item on the Lewis Silkin age discrimination website, Mr Wong had argued that he was made redundant because of his age and to save them money. He claimed that Bovis gave younger less experienced men the opportunity of applying for higher positions instead of him.

The tribunal held that Mr Wong was fairly dismissed for redundancy and that his claim for age discrimination was not well founded. This seems to have been on the basis that his job had been unique within the company and the role was being dispensed with.

However, the tribunal also decided that Bovis had breached Mr Wong’s contract by not paying him his full bonus.
