Law firm Trowers & Hamlins have issued this handy guide to a number of recent legal decisions in age discrimination cases.
They identify some of the practical implications of these judgments and the lessons that can be learnt from them.
These include what is meant by a ‘legitimate aim’ – this is relevant to deciding whether direct age discimination is justified as this has to be by reference to legitimate aims which are ‘social policy objectives’.
Another area is the extent to which costs can be taken into account in determining what can be justified.
