Too old to work?

The Supreme Court will start hearing a test case today on age discrimination involving a former law firm partner forced to retire at 65.

The case has been working its way through the courts for a number of years during which time the default retirement age has been abolished. The judgment in this hearing is therefore expected to be an important guide to clarity about how, when and if organizations can require individuals to retire.

In a debate about the hearing on the Today programme this morning the underlying assumption seemed to be that older staff are necessarily going to be in senior positions – surely not always the case.
